1. Scope
These Terms apply to champcar.org, related ChampCar-controlled websites and pages, event and membership portals, official forms, official digital communications, and any online content or services we make available. These Terms do not apply to third-party sites, tools, or services that we do not control, even if we link to them.
In these Terms, “ChampCar,” “we,” “us,” and “our” mean ChumpCar International, Inc. d/b/a ChampCar Endurance Series.
2. Eligibility and accounts
- You must provide accurate, current, and complete information when creating an account, purchasing a membership, entering an event, or submitting forms.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- You must promptly update inaccurate or outdated information, including contact information and emergency contact information when applicable.
- If you are registering or acting on behalf of a team, organization, or other person, you represent that you have authority to do so.
- Minor participants may be subject to additional requirements, approvals, releases, and eligibility rules.
3. Memberships and registrations
- Memberships, event entries, rentals, and purchases are subject to availability, eligibility, published requirements, and payment of applicable fees.
- Membership and event benefits, pricing, deadlines, schedules, classing, and event formats may change.
- Submitting a registration or payment request does not guarantee acceptance into an event, class, or activity.
- ChampCar may reject, cancel, modify, or limit registrations, entries, memberships, or purchases when reasonably necessary for safety, compliance, capacity, staffing, facility, competitive, administrative, or operational reasons.
- Refunds, credits, transfer rights, and cancellation rules are governed by the applicable published event, registration, or purchase terms then in effect.
4. Rules, waivers, and event authority
Participation in ChampCar activities is subject to all applicable club rules, technical rules, supplemental rules, event notices, track requirements, waivers, policies, and instructions from ChampCar officials, race control, tech inspectors, and event staff.
- The current BCCR, supplemental rules, event notices, and official ChampCar directives control event participation and conduct.
- Track owners, sanctioning partners, insurers, and facility operators may impose additional rules or access conditions.
- You are responsible for reading and complying with all event documents that apply to you, your team, your vehicle, and your crew.
- Nothing on this website limits the authority of ChampCar officials to interpret, apply, or enforce rules or make event operations and safety decisions.
- Required waivers and releases remain separate binding agreements in addition to these Terms.
5. Acceptable use
You agree not to:
- Use the site in violation of any law, rule, or regulation.
- Attempt to gain unauthorized access to accounts, systems, registration data, or non-public pages.
- Interfere with site operation, security, performance, or availability.
- Scrape, harvest, or bulk-download site content or user data except as expressly authorized in writing.
- Submit false, misleading, fraudulent, or impersonating information.
- Upload or transmit malware, malicious code, spam, or abusive content.
- Use ChampCar marks, logos, graphics, photos, or media in a misleading, infringing, or unauthorized manner.
- Use the site in a way that harms ChampCar, our members, teams, staff, volunteers, partners, or facility relationships.
6. Content and intellectual property
Unless otherwise noted, the site and its content, including text, graphics, logos, photos, videos, schedules, layouts, branding, downloadable materials, and compilations, are owned by or licensed to ChampCar and are protected by applicable intellectual property laws.
- You may view, download, and print site content for personal, informational, and non-commercial use related to ChampCar participation.
- You may not reproduce, republish, distribute, modify, create derivative works from, publicly display, or commercially exploit site content without prior written permission, except where the law clearly allows it.
- ChampCar names, logos, event marks, and related branding may not be used in a way that suggests sponsorship, endorsement, or official status without permission.
7. User submissions
If you submit comments, photos, videos, survey responses, suggestions, testimonials, team information, car information, logos, documents, or other materials to ChampCar, you represent that you have the right to provide them.
Unless we agree otherwise in writing, you grant ChampCar a non-exclusive, worldwide, royalty-free license to use, reproduce, modify for formatting, publish, display, distribute, and archive those submissions for club, event, historical, promotional, operational, and administrative purposes.
We are not required to publish or retain any submission and may remove or decline content at our discretion.
9. Third-party services and links
ChampCar may link to or integrate with third-party services such as registration systems, payment processors, timing providers, livestream platforms, map services, cloud documents, sponsor pages, and social platforms.
- We do not control third-party sites or services and are not responsible for their content, policies, availability, or performance.
- Your use of third-party services is governed by their own terms and policies.
- Links are provided for convenience and do not necessarily imply endorsement of every third-party service or statement.
10. Disclaimers
The site and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, ChampCar disclaims warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- We do not guarantee uninterrupted access, error-free operation, or that the site will always be secure or available.
- Schedules, event formats, facility details, technical information, classifications, staffing, race operations, weather impacts, and timing may change without notice.
- Site content is provided for general informational purposes and does not replace official event control communications, posted notices, safety directives, rules interpretations, or staff instructions.
- Nothing on the site is legal, mechanical, engineering, safety, medical, or tax advice.
11. Limitation of liability
To the fullest extent permitted by law, ChampCar and its officers, directors, employees, contractors, volunteers, officials, agents, sponsors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, business opportunity, or anticipated savings, arising out of or related to your use of the site or services.
To the fullest extent permitted by law, ChampCar’s total liability for claims arising out of or related to the site or these Terms will not exceed the greater of one hundred U.S. dollars ($100) or the amount you paid directly to ChampCar through the specific online transaction giving rise to the claim in the twelve months before the event giving rise to the claim.
This limitation applies whether the claim is based in contract, tort, negligence, strict liability, statute, or any other theory, even if we were advised of the possibility of such damages.
12. Indemnification
You agree to defend, indemnify, and hold harmless ChampCar and its officers, directors, employees, contractors, volunteers, officials, agents, sponsors, and affiliates from and against claims, demands, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your breach of these Terms.
- Your misuse of the site or services.
- Your submissions, content, or materials.
- Your violation of law, rule, regulation, or third-party rights.
- Your team, crew, vehicle, or account activity where you are the responsible party.
13. Suspension and termination
ChampCar may suspend, restrict, or terminate access to the site, accounts, registrations, memberships, or services at any time, with or without notice, if we reasonably believe it is necessary for security, legal compliance, operational needs, fraud prevention, rule enforcement, safety, or protection of the club and its members.
Sections that by their nature should survive termination will survive, including sections on intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute-related provisions.
14. Governing law and venue
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any dispute arising out of or relating to these Terms or your use of the site will be brought exclusively in the state or federal courts located in or serving Virginia, and you consent to that jurisdiction and venue.
15. Changes to these terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of the site or services after the updated Terms become effective constitutes acceptance of the revised Terms.
